Term and conditions of use

Article 1: application fields and modifications to the general conditions of sale.

The present conditions of sale apply to all sales made on the internet websites www.bijoux-cante.fr and www.bijoux-cante.com.

1: SARL CANTE reserves the right to alter, adapt or modify the conditions of sale at any moment. Any modifications made will apply to each order placed from the day of the order.

 

Article 2 : product availability

Our products and prices are valid if they are visible on the site.

Within 30 days of receipt and validation of your order we engage to deliver your product or to reimburse you (if the value is more than 500euros) or in the form of a credit note (if the value is less than 500 euros).

In the event of receiving a credit note, you can ask to cancel it and receive a cheque in its place. You simply have to contact our Customer Services; you can contact them by phone or by post. In order for us to effectively and efficiently deal with your request please clearly state your order number and your full contact details.

The validated order date corresponds to;

1- the date of the order - if payment was made by bank card on line.

2- the date of receipt of the cheque - if payment was made by cheque.

Articles on pre-order

The official release/availability date is visible on the item on the website.

Pre-ordering gives you the possibility to buy and reserve your product in advance. This guarantees that the item will be available to you as soon as it is released.

Warning:

Sarl CANTE can, at any moment change the official release date. In the case of any modification to the release date the client can fully or partially cancel their order, simply by contacting our customer services.

 

Article 3 : order validation and validation of the electronic signature (electronic signature legislation/law 13 march 2000)

Each confirmed order signed by the purchaser by 'double clicking' constitutes an indisputable acceptance that cannot be reverted within the agreed time limits of the conditions of sale. The 'double click' signature ie; the electronic signature is as valid as a manual signature.

 

Article 4 : price

The Sarl CANTE company reserves the right to modify their prices at any moment, however will honour any tariffs agreed at the time of sale/order.

 

Article 5: methods of payment and security.

5-1: methods of payment

Credit card

Security and payment by credit card is via the banks server. This means that no personal banking information will be transmitted to the Sarl CANTE site. Payment by credit card is, therefore, perfectly safe; your order will be registered and validated as soon as your chosen bank confirms the payment.

Bank cheque

Your order will be processed as soon as the bank have validated/cleared your cheque

5-2: security

Your card details are encrypted (SSL; secure socket layer) and as such are never accessible, the payment is dealt with directly by the bank. Sarl CANTE can at no time access your card details and does not keep them on the server, because of this you will be asked for your card details every time you place an order and make a new transaction on our site.

5-3: ownership clause

The products remain under the ownership of Sarl CANTE until completion of the order, as soon as the goods have been delivered the ownership transfers to the client and is no longer the responsibility of Sarl CANTE.

5-4: payment default

The company Sarl CANTE reserves the right to refuse to honour or deliver an order if the purchaser has not made partial or full payment or if the client hasn't made payment for a previous order or for one which is in the process of administration.

5-5: anti-fraud checks

Sarl CANTE checks every order that have been validated on their site. These checks protect the company against fraud and fraudulent activity.

For an order that presents a delivery address different from the billing address our service can contact both parties involved to confirm that the person at the billing address is in fact connected with the delivery address. In a case such as this our service can ask you for all information necessary to unblock your order, ie; proof of address and bills in your name and proof of address for the recipient at the delivery address.

Any requests such as these will be made by email or by recorded post.

 

Article 6 : responsibility

The company SARL CANTE cannot be held responsible for any delays or failure to execute the sale contract due to problems within the postal company; strikes, transportation, floods or fires etc.

The decision to buy a product is the sole responsibility of the client, errors, notably with sizing is not the responsibility of the company and is not reason enough to receive a refund. Refunds will be awarded in the case of non-conformity and/or defects.

In case of non-delivery of your order or part of your order you have up to a maximum of 6 months (starting from the date the order leaves our workshop) to claim. Beyond the 6 months limit we will not accept any claim.

 

Article 7 : return rights

7.1: procedure and general return conditions

In order to enable us to treat your return request with optimal efficiency you must first make a request to return your item(s), this request must be made as soon as possible as different time scales are to be respected – please refer to point 9.2 onwards.

Once you have received our agreement to accept your package then you must return it to us within 15 days. If you exceed this time limit the package will be refused. We advise you to send the package using a recorded tracker service so that if there are any problems with the delivery you may track the package and if necessary launch an inquiry into any problems or delays. Please note that any packages sent to us by you are YOUR responsibility.

Please ensure that you include your contact details and your customer number with your package.

NB; on receipt of the package we will verify that it conforms to the description. If it does not conform then it will be returned to you at your cost. We will verify that the reason for the return corresponds with the piece; we reserve the right to notify you by email of any changes.

7.2: return conditions

You have 15 days to notify us if the item(s) you receive is not the item(s) ordered (reference error, size, colour, characteristics, product completely different) this is so that our customer services department can provide you with a returns agreement number.

The product must be returned in good condition in its original packaging even if it has been opened.

In order for us to be able to efficiently handle your return please provide us with your order number and your contact details.

7-3: Return costs

Having received the package we will issue you with a credit note to the value of the postage (please include your receipt), in relation to average postage charges. We may however contact you and ask you to provide us with proof of the value of your postage.

The amount reimbursed cannot exceed €20, 00.

7-4: Retraction returns

Conforming with article L.121-20 and in accordance with the consumer code, you have 7 working days from the date of delivery to return your order to us, in its original packaging in good condition. You must contact us to request the return, refund or exchange. Our customer services department will provide you with your returns agreement number. Postage is at your cost.

NB: the return will only be accepted if the product is returned to us in perfect condition, in its original packaging, not marked, dirtied, damaged in any way, the product must also be returned with accessories where appropriate. In the case of defaults the product will be returned to you at your cost.

7-5: Charges relating to retractation returns

At your cost.

 

Article 8: guarantee

Sold articles are to be cared for and used in normal conditions. We cannot guarantee items that have been worn / used outside of their normal reasonable conditions of wear/usage.
